    I spoke with you this evening at the UCSC grad student tax service about my wife. She is a Chinese national that came here on an F-1 student visa which says she has no intent to immigrate. We got married in the early part of 2012 and at some point in the next year or so she should get a green card. Her tax return is much better using a 1040 than the 1040-NR. Clearly by marrying me (a US citizen) her immigration intent changed. However the marriage occurred in 2012. Will it be a problem if she files the resident return instead? Many thanks.

    • Hi Nick,

      For income tax purposes, your wife may elect to file as a US Resident. The imigration and visa status is a starting point for determining residency for tax purposes, but is not the final determining factor. The tax courts look to your intentions for residency.

      Yes your employer is paying your taxes for you on your wages. So, you have already paid the taxes you had to pay. In fact, you are likely due a refund of overpaid taxes. Say hi to your employer for me.
